Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the AffluentReach website and online service (the “Service”). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is intended for business use. You represent that you are of legal age to enter into a binding agreement and that, if you are using the Service on behalf of a business or other organization, you have authority to bind that organization.

You agree to provide accurate account information and to keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@affluentreach.com if you believe your account has been accessed without authorization.

Access to the Service is offered on a subscription basis at the price and billing interval presented at the time of purchase. Unless canceled in accordance with the cancellation process made available in the Service or by contacting us, subscriptions renew automatically for successive periods, and the payment method on file will be charged each period. Fees are stated exclusive of applicable taxes unless indicated otherwise. We may change pricing prospectively with notice; changes do not apply to a period already paid for.

We may offer free trials, introductory pricing or other promotional terms. Eligibility and duration are as stated in the offer. Unless the offer says otherwise, a trial converts to a paid subscription at the end of the trial period unless canceled before it ends. We may modify or discontinue promotional offers at any time.

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your own internal business purposes.

You agree not to:

• resell, sublicense, or provide the Service to third parties as a service bureau;
• copy, scrape, mirror or systematically extract the Service or its content;
• reverse engineer or attempt to derive source code, except as permitted by law;
• interfere with, overload, disrupt or attempt to gain unauthorized access to the Service or related systems;
• use the Service to send unlawful, deceptive, harassing or unsolicited bulk communications;
• use the Service in violation of applicable law or third-party rights.

You are solely responsible for the accuracy, legality and appropriateness of the organizations, contacts, opportunities, notes, communications and other information you enter into or generate through the Service, and for how you use that information, including compliance with applicable communications, marketing and privacy laws.

The Service may link to or integrate with third-party websites, data sources or services. Those services are provided by their respective operators under their own terms, and we are not responsible for their content, availability, accuracy or practices. Your use of a third-party service is at your own discretion and risk.

The Service includes features that use artificial intelligence or automated processing to research, summarize, organize and prioritize information. Automated output may be incomplete, outdated or inaccurate. You are responsible for reviewing and verifying AI-assisted results and any research, contact information or recommendation before relying on it, contacting an organization or making a business decision.

AffluentReach is a research, organization and business-development tool. We do not guarantee that any opportunity identified through the Service will be available, accurate or suitable, or that your participation will result in an accepted donation, an event placement, a relationship, a client, a sale, revenue or any other business outcome. Results depend on your market, your studio, your effort and many factors outside our control.

The Service, including its software, design, interfaces, text, graphics, branding and all related intellectual property, is owned by AffluentReach or its licensors and is protected by applicable law. Except for the limited right of use granted in these Terms, no rights are transferred to you. Feedback you provide may be used by us without restriction or obligation.

As between you and AffluentReach, you retain ownership of the business data you provide to or enter into the Service. You grant us a limited license to host, process, transmit, display and otherwise use that data as necessary to operate, support, secure and improve the Service and to provide it to you.

We aim to keep the Service available, but access may be interrupted for maintenance, updates, technical issues or events outside our control. We may add, modify or discontinue features from time to time. Where a change materially reduces core functionality, we will make reasonable efforts to provide notice.

You may cancel your subscription at any time as described in the Service. We may suspend or terminate access if fees are unpaid, if the Service is used in violation of these Terms or applicable law, if there is a security or operational risk, or if we discontinue the Service. Upon termination, your right to use the Service ends. We will make your business data available for a reasonable period following termination where practicable, after which it may be deleted.

Except as expressly stated in these Terms and to the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted or error-free operation.

To the fullest extent permitted by applicable law, AffluentReach will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business opportunities, or loss or corruption of data, arising out of or relating to the Service, even if advised of the possibility of such damages. To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and provide notice where required. Your continued use of the Service after an update takes effect means you accept the revised Terms.
